1. Responsibility
The Company will not be liable for any personal or material damages arising from the Hirer’s party.
The Company will not be held liable or be responsible for any articles left in the vehicle. Articles will be returned using the standard postal service with proof of postage. Where the article is considered to be of high value then it will be the responsibility of the Hirer to arrange collection. The Hirer agrees to pay the Company any costs incurred for the return of the article.
Where a direct collection from a specific address or location is not possible, the Chauffeur will contact the Hirer to advise an alternative location or address for collection of the Hirer or the Hirer’s party.
If the weather conditions (or a force majeure) are such that the safety of the Hirer, the Chauffeur or the Vehicle may be compromised or placed at risk then the Company or the Chauffeur may at its entire discretion cancel the Hire in part or in its entirety. In such circumstances the liability of the Company shall be limited to a refund the Hire Charge. The Hirer accepts that the Company or the Chauffeur shall retain this discretion in the interests of the safety of the occupants and the Vehicle, furthermore, the Hirer accepts that the liability of the Company shall be limited to refund of the Hire charge or part thereof.
2. General Conduct
The Hirer is responsible for the general conduct and behaviour of his or her party.
The Hirer agrees to be held liable for the reasonable cost of any repair as a consequence of any damage caused to the vehicle, interior or exterior by either the Hirer or their party.
The consumption of food is not permitted in the vehicle unless specific agreement has been made to the contrary at the time of the booking and agreed in writing. The Company will not allow red wine to be consumed in the vehicle at any time owing to the potential damage to the interior as a consequence of spillage. The opening of Champagne bottles can be hazardous to the occupants of the vehicle and may give rise to damage to the Vehicle; therefore, Champagne bottles may only be opened by the Chauffeur or by the Hirer or his or her party outside and away from the vehicle. The Hirer accepts responsibility on behalf of the Hirer’s party for any losses or damage to the property of the Company that is provided in the vehicle for the benefit or the pleasure of the passengers. This is includes, but is not limited to, glassware, CD’s, and the like.
3. Safety
The Hirer accepts that the Company adopts a strict no smoking policy in its vehicle and shall be held responsible for the cost of a valet and any damage caused as a consequence of the Hirer of his or her party failing to adhere to this agreement.
It is a legal requirement that all passengers wear a seat belt where fitted. The Hirer expressly accepts that except in cases of an emergency, only the Chauffeur may open and close doors, this is a safety precaution to minimise the risk of accidents and damage to the vehicle. The maximum number of passengers that can legally be carried in the vehicle is 4. There is a limit on the amount of luggage that can be safely and legally carried in our vehicle. Therefore, the Hirer should, if in doubt, advise the Company in writing and in advance of the Hire of the number of pieces of luggage that they wish to carry, the dimensions and the approximate weight. The Hirer agrees that the final determination on whether or not the luggage can be practically carried is with the Chauffeur.
4. Limitation of liability
It is the responsibility of the Hirer to ensure that there is adequate time to travel to and from destinations, the Company or its employees will provide advice, but this does not form any part of the contract between the Hirer, the Hirer’s party or the Company and its Employees.
In the event that a vehicle is subject to an accident or mechanical failure, or is no longer safe to drive, then the Company shall make alternative arrangements to get the Hirer and his or her party to their destination.
It is the responsibility of the Hirer to determine whether the Vehicle has been hired for a sufficient period and peak traffic periods and any additional time over and above the Booking period shall be charged at the appropriate rate.
Where time is critical, the Company recommends that the Hirer allows sufficient time to ensure that no disruption to the schedule is incurred as a result of unexpected or unavoidable delays. The Company recommends that the Vehicle is at the collection point at least 30 minutes prior to departure.
5. Payments, deposits, reservations, bookings and refunds
The company’s prefered method of payment is through our Paypal facility. You can pay through Paypal facility by one of two options:
Option1. Using your Paypal account (usually linked to your chosen bank account for debiting of funds)
Option 2. By paying through Paypal and using either a credit card or Visa debit card
We will also accept cheques providing the cost for services is paid in one lump sum (deposit plus remaining balance).
We also accept payment through BACS transfer, again payment would be required in one lump sum (deposit plus remaining balance)
To make a reservation the Hirer shall be required to pay a Deposit which shall be £90 for services to be rendered. Paying a deposit will confirm the reservation. The period during which the Hirer can cancel and receive a refund without reason is up to 63 days prior to the confirmed reservation booking date, less a charge of £30 administration charges.
Within 49 days of the confirmed reservation booking date, the Hirer accepts that, whether a deposit (confirmed reservation) or full balance due paid (confirmed booking), in any event a refund will be provided after the deduction of administration charges and potential loss of earnings of £70. No refunds will be permitted whatsoever for any reason should the hirer cancel the booking within 42 days of the confirmed booking date. This policy also applies to any bookings that are made within 42 days of confirmed booking date.
The full Balance becomes due 42 days prior to the date of the Hire. Failure to pay the full balance by the Due Date will result in the cancellation of the Hire and the loss of any Deposit paid.
The Company will submit an invoice for the remainder of the full balance due to The Hirer through our Paypal facility via E mail, once a deposit has been paid – currently £90. The date the full balance is to be paid will be shown on this invoice.
5.1 Winter promotional offer 2012/13
15% discount – Winter promotional offer – Applies to bookings between November 1st 2012 to March 31st 2013.
Full payment is due the same day as booking (making a deposit). Our refund policy remains the same however. The Company will request to The Hirer via E mail invoice (following making a deposit) that payment of the remainder of the balance is due immediately.
5.2 Spring/Summer promotional offer 2012
15% discount – Applies to bookings Mondays to Thursdays only between April 1st 2012 to October 31st 2012. Full payment is due the same day as booking (making a desposit). Our refund policy remains the same however. The Company will request to The Hirer via E mail invoice (following making a deposit) that payment of the remainder of the balance is due immediately.
5.3 Once the full balance has been paid The Company will send an invoice marked as paid in full and booking confirmation letter to The Hirers home address via the postal service confirming such. This will also act as official confirmation that The Company is to provide services as described for The Hirers chosen booking date.
The Hirer accepts that the Company does not issue a reminder when the Balance is due and it is entirely the Hirer’s responsibility to ensure that the full Balance due is paid on or before the Due Date (a minimum of 42 days prior to the confirmed booking date).
Should The Hirer wish to make a booking within 42 days of the confirmed arranged booking date of the Hire, then a non refundable 100% of the quote for services to be rendured will be immediately payable to the company by means as mentioned above.
6. Additional charges
Time permitting; the Chauffeur may be willing to collect additional passengers, subject to the maximum that the Vehicle can carry, at alternative locations. However, any additional mileage or time shall be charged to the Hirer. Whilst the Chauffeur will attempt to accommodate any last minute changes, the final decision will remain with the Chauffeur and the Hirer expressly accepts this arrangement.
In the event that the Hirer makes any changes to the Booking Form within 14 days of the date of the Hire, then the Company shall charge £10 for each instance and the Hirer agrees to pay such charges immediately.
Where the Hire extends beyond the period of the Booking the Hirer accepts that this additional time and mileage shall be charged to the Hirer at the appropriate rate (currently £35 per hour).
In the event that the Vehicle has been left in an unreasonable condition by the Hirer or his or her party, then the Company reserves the right to charge for the cost of a valet. Such circumstances that could give rise to this charge include, but are not limited to; spillage of food or drinks, smoking and illness. (The use of confetti in the vehicle is acceptable).The minimum cost of a valet is £60, but this amount could increase dependant on the consequential damage. The responsibility for reimbursement of such cost is that of the Hirer.
7. Time limitation
The company operate a minimum of three hours service to The Hirer. This duration will commence upon The Hirers first chosen pick up point.
It is the responsibility of The Hirer to ensure the minimum hire period is sufficient for the requested travel destinations, time spent at venue, the reception, including photo shots, etc.
The maximum duration of hire from The Company to The Hirer is twelve hours from the initial pick up point to the final drop off point.
8. Other conditions
Any requests for our service must be in connection with the wedding event only. This includes additional collection requests and transportation to/from your chosen venue. The company will we able to transport you to your onward destinations following your wedding, ie to airports/ports, etc, however to satisfy our wedding car insurance policy this must be booked as part of the wedding package. The Company will not be able to offer you carriage outside of this scope.
The Company has passenger liability insurance and is comprehensively insured for the purpose of For Hire or Reward.
Any Hirer must be over the age of 18.
All the above will also apply to any promotional special offers or general promotions.
